Roszdravnadzor audits medical and pharmaceutical professionals, heads of medical and pharmaceutical organizations for compliance with actions prohibited in course of their professional practice.
Prohibited practices are restrictions imposed on medical and pharmaceutical professionals in course of their professional activity (Article 74 of the Federal Law dated 21.11.2011№ 323-FZ “On Fundamentals of the Protection of Citizen’s Health in the Russian Federation”).
1. Medical professionals and heads of medical institutions are prohibited from:
1) receiving gifts, money payments (except for those under agreement in course of clinical studies of medical products, clinical trials of medical devices, or performance of teaching and (or) scientific activity), including payments covering costs for entertainments, leisure time, trips to recreational places from organizations engaged into development, manufacture and (or) distribution of medical products, organizations engaged into wholesale of medicines, pharmaceutical organizations (their representatives and other individuals and legal entities) (hereinafter referred to as a company and a representatives of a company) as well as taking part in entertainment events financially supported by a company, a representative of a company;
2) coming to an arrangements with companies and representatives of companies on prescribing or recommending certain medical products and medical devices to patients (except for agreements on conducting clinical studies of medical products, clinical trials of medical devices);
3) receiving samples of medical products, medical devices from companies, representatives of companies for giving these products to patients (except in the context of conducting clinical studies of medical products, clinical trials of medical devices);
4) providing a patient with misleading, incomplete or incorrect information about used medical products and medical devices as well as hiding the information about availability of analogous medical products and medical devices;
5) meeting with representatives of pharmaceutical companies, manufacturers or sellers of medical devices, except for cases related to carrying out clinical studies of medical products, clinical trials of medical devices, participation in meetings of medical professionals or other events related to their professional advancement, or providing information on all cases of detection of side effects not listed in the instructions or the operating instructions of the medical device, adverse reactions, interaction of health care products and the facts and about the circumstances that threaten the life and health of citizens and healthcare professionals in the application and operation of medical devices.
6) prescribing medical products, medical devices on forms containing advertising information as well as on prescription forms that already contain the name of a medical product or medical device.
2. Pharmaceutical professionals and heads of pharmaceutical institutions are prohibited from:
1) receiving gifts, money payments including those covering expenses for entertainment, leisure time, travels to recreation places as well as taking part in entertainment events financially supported by companies or representatives of companies;
2) receiving samples of medical products, medical devices from companies representatives of companies for giving these products to the population;
3) concluding agreements with companies, representatives of companies agreements on offering of certain medical products, medical devices to the population;
4) providing the population with unreliable or incomplete information about availability of medical products, having the same international nonproprietary name, medical devices, including hiding information about availability of less expensive medical products and medical devices.
